Gisèle Pelicot makes her way back to the courtroom after groundbreaking trial transformed her into an icon - and ripped her family unit

The first day Gisèle Pelicot walked up the steps of the courthouse in the French city in last fall, she was an anonymous elderly woman.

Shortly thereafter, this small-statured 72-year-old - the victim at the heart of the biggest criminal proceedings in France's judicial records, including fifty-one defendants including her partner - had transformed into a symbol of resilience.

Her most recent public appearance in public when the verdicts - all guilty - were delivered in December. By then, groups of supporters were shouting her name.

On Monday the survivor returns to court, this time in the southern city, for the appeal of the sole individual of the 51 defendants to contest his sentence: the 44-year-old, forty-four, a married father of one offspring.

The Legal Proceedings Which Rocked French Society

Over a three-month period in 2024, the grandmother's harrowing narrative travelled internationally. Throughout multiple years, she had been sedated into unconsciousness by her husband Dominique and assaulted by multiple individuals he had solicited on internet chat rooms.

The perpetrator recorded the assaults and neatly catalogued them on a storage device, which allowed authorities to track down the greater part of the persons participating. Approximately twenty could not be identified and continue to be unapprehended.

Subsequent to a legal proceedings lasting multiple weeks, 46 men were convicted of violation, two individuals of attempted rape and two others of sexual assault. The primary perpetrator was given the most severe jail sentence of 20 years.

The Legal Challenge Process

The appellant's retrial next week will, essentially, be a new trial. The footage of Gisèle's assault will be displayed in the courtroom once more, and the husband will be in attendance – on this occasion, however, only as a witness.

Even though she is not required to, Gisèle also will participate in the legal process.

"All people would have comprehended if she chose not to attend since, you see, she is striving to regain a regular existence," one of her legal team, the attorney, informed. "But she feels she needs to be there and has a duty to be present up to the conclusion of the legal process."

During the winter, the defendant was found guilty of aggravated rape and sentenced to a nine-year term in incarceration. Owing to health reasons he was handed a deferred custody warrant and is not currently in custody. He is allegedly contesting both guilty verdict and the length of his prison term.

Legal Arguments

As was the case for many of the remaining multiple perpetrators, Dogan's strategy depended on the claim he did not be guilty of assaulting Gisèle because he had failed to recognize she would be unconscious. The perpetrator disputed this claim, stating he had explicitly stated to the men he enlisted online that his wife would be medicated.

During his testimony last year the defendant acknowledged telling the perpetrator that his spouse "seemed unconscious". Nevertheless, he forcefully objected regarding the allegations levelled at him. "I don't accept being labelled a rapist," he argued. "The weight is unbearable a responsibility for me to carry."

Even though sixteen additional perpetrators as well originally lodged legal challenges, Dogan was the lone person who has pushed ahead with it.

Family Rift

As the trial began in last year, she was accompanied by her each of her grown offspring – Caroline, David and Florian. Now, the close family group that entered the Avignon tribunal previously is no more.

One son and Caroline Darian have described themselves the "unrecognized sufferers" of the case and next week in the new location, the mother will solely be joined by the younger child, the most junior of her children.
